3.4 Business Use: Each restaurant location requires a separate account unless otherwise agreed.
4.1 Subscription: The Service is provided on a recurring subscription basis.
4.2 Billing: Subscriptions are billed in advance and auto-renew unless canceled.
4.3 No Refunds: All payments are final and non-refundable.
4.4 Payment Processors: Payments may be processed via third parties (e.g., Stripe, RevenueCat).
You agree not to:
6.1 Ownership: You retain ownership of your data.
6.2 License to Process: You grant us a limited license to process data to operate the Service.
6.3 Security: We use commercially reasonable safeguards but do not guarantee absolute security.
6.4 Backups: You are responsible for maintaining backups of critical data.
You are solely responsible for:
We are not liable for violations of messaging laws.
All Service-related intellectual property remains owned by Simple Host App.
You are granted a limited, non-exclusive, non-transferable license to use the Service.
By using the Service, you grant Simple Host App a non-exclusive, worldwide, royalty-free right to use your restaurant name, logo, and brand identity for marketing, promotional, and demonstration purposes, including on our website, advertising, sales materials, and investor presentations.
You may opt out at any time by providing written notice.
We use commercially reasonable technical and organizational measures to protect data, including encryption in transit and industry-standard cloud infrastructure.
We aim for high availability but do not guarantee uninterrupted service.
Maintenance, updates, or outages may occur.
The Service integrates with third-party providers (e.g., Stripe, Twilio, RevenueCat).
We are not responsible for their performance, uptime, or policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the maximum extent permitted by law:
You agree to indemnify and hold harmless Simple Host App from claims arising from:
16.1 By You: You may cancel at any time.
16.2 By Us: We may suspend or terminate accounts for violations or risk.
16.3 Effect: Access ends immediately. Data export may be requested within 30 days.
We may update these Terms at any time. Continued use constitutes acceptance.
These Terms are governed by the laws of South Carolina.
All disputes shall be resolved through binding arbitration.
You waive class action rights.
Enterprise or multi-location customers may be subject to separate agreements (MSA), which will control in the event of conflict.
These Terms represent the entire agreement.
If any provision is invalid, the remainder remains enforceable.
